Court filings soar as Vioxx deadline looms

Fort Worth plaintiffs'' attorney John David Hart and other Texas lawyers will be making their way to the courthouse in the next few days to file additional Vioxx lawsuits before the Texas statue of limitations expires on Sept. 30, 2006, PRNewswire reports. Hart says he will be filing 22 or more new Vioxx claims before the Sept. 30 deadline, in state and federal courts in Texas and throughout the United States. Whitehouse, NJ-based pharmaceutical company Merck & Co. Inc. withdrew Vioxx from the market on Sept. 30, 2004. Merck''s actions came after one of the company''s own studies showed Vioxx use doubled the incidence of heart attacks and strokes in patients. Other studies suggest the risk of cardiovascular problems among Vioxx users is even higher. Under Texas law, all patients who took the drug and suffered injuries must file their claims by Sept. 30, 2006, in order to comply with state statute of limitations laws. States other than Texas may have different limitations for filing of Vioxx claims.
